I. General:

These General Terms and Conditions (hereinafter referred to as “T&Cs”) apply to the organization of the Conference and the ordering of all types of tickets for NEXT Conference events. The NEXT Conference is a co-operation between FAKTOR 3 Live GmbH, Kattunbleiche 35, 22041 Hamburg and Accenture Song Build GmbH, Völkersstraße 38, 22765 Hamburg (hereinafter referred to as ‘NEXT Conference’ or ‘the organiser’).

NEXT Conference has appointed Cvent Deutschland GmbH (Cvent) as service provider for the ticket process of NEXT Conference. Cvent enables the registration for, and payment of, tickets for NEXT Conference. If the customer makes direct use of Cvent’s services, e.g. via its website or other processes in which Next Conference is not directly involved, Cvent´s T&Cs must be observed where applicable.

By ordering tickets for NEXT Conference, the customer accepts these following T&Cs. Any other terms and conditions have no validity.

II. Conclusion of contract:

1. Conclusion of contract
NEXT Conference is an invitation only event. We select our crowd as carefully as we curate our programme to ensure a diverse experience. Applying for a ticket is the first step to being a part of the NEXT Conference. Submitting an application on the NEXT Conference website does not mean the customer is committed to buy a ticket later. NEXT Conference will let the customer know via email within five days whether or not his or her application has been accepted.

With the confirmation email, the NEXT Conference will send the customer a link to the ticket order with instructions on how to order the ticket. Tickets can only be ordered via this link, which takes the customer to Cvent, the NEXT Conference ticket tool. The ticket price and the statutory VAT are displayed in the last step and the customer then selects the payment method. The contract for the purchase of the ticket is concluded when the customer clicks on “Book now” in the ticket tool.

An email is then sent from the Cvent ticket tool to the address provided by the customer when placing the order. This email contains a confirmation of the order including the NEXT Conference ticket (PDF, QR code and wallet ticket), a link to the order confirmation and information on how the order can be viewed.

The customer is free to change his contact and tax details at any time via the link in his or her ticket email. The customer will not receive any additional ticket/s by post.

2. Admission regulations
Customers are obliged to check received tickets for errors regarding price, date, event and venue. The customer shall be solely responsible for safeguarding the tickets and for bringing them with him or her to the event.

Tickets can only be purchased for personal use. Purchase for profitable repurchase (commercial use) is prohibited. An exception is the raffle of tickets by cooperation partners of NEXT Conference.

Customers can provide a hard copy. The validity of the ticket is guaranteed by a printed barcode, which is checked at the entrance by means of a barcode scanner. A multiple access to the event by duplicated tickets is thus excluded.

Alternatively, the tickets can be saved as a digital version on a mobile device with the appropriate iOS / Android app. In this case, the barcode will be scanned and checked at the entrance point.

In exchange for the ticket the customer will receive a wristband enabling entry to the NEXT Conference event for which he or she booked, as well as – if required – a wristband enabling entry to the Reeperbahn Festival. Both wristbands must be put on immediately and may not be passed on to other persons. In the case of lost tickets or wristbands, no claims for a refund of the attendance fee, or for a replacement ticket or wristband, will be entertained. The reproduction of tickets or wristbands is not permitted. The customer is obliged to hold on to tickets or wristbands in such a way as to prevent any misuse. The customer will be held responsible for misuse of the tickets.

In the event that the customer has purchased concessionary rate tickets (e.g. Student Ticket), the customer shall produce the necessary proof of eligibility when entering the event. Tickets are to be presented at registration upon entering the venue.

3. Terms of payment and due date
The customer is able to choose between payment by invoice or credit card (in case of paying by credit card this will be processed via Stripe).

Payment is due within 14 days after receiving the NEXT Conference ticket via email.

In the event of late payment or credit card, NEXT Conference reserves the right, but does not undertake, to withdraw from the contract or refuse participation in NEXT Conference events until the outstanding amount has been paid.

If payment by invoice is not received 14 days before the NEXT Conference, the ticket loses its validity.

4. Data protection, collection and processing
Invitation management, registration and the provision of admission tickets are generally carried out via NEXT Conference’s own websites, the underlying application systems, social media and targeted sales channels. For this purpose, customers give the necessary consent to the use of the data provided by them, such as name, date of birth, address, profession, email address. To the extent necessary for the fulfilment of the contract, Next Conference may disclose the data to third parties. NEXT Conference has appointed Cvent Deutschland GmbH (Cvent) as service provider for the ticket process of NEXT Conference. Cvent enables the registration for, and payment of, tickets for NEXT Conference. If the customer is directed to Cvent websites or uses them in any other way, Cvent is the controller within the meaning of data protection law.

NEXT Conference plans and promotes the Events through Cvent and facilitates registration and the provision of tickets and other attendance materials through Cvent. By using Cvent’s services or allowing others to use the services on customer’s behalf, customer agrees that Cvent may collect, use, disclose, transfer and store customer’s personal information or other information obtained by Cvent through such use in accordance with Cvent’s Privacy Policy.

NEXT Conference attendees have the opportunity to register for the NEXT conference information service via email. This contains information on conference participation, news, promotions and offers as well as other invitations from the organiser in connection with the NEXT Conference.

The NEXT Conference is jointly organised by Accenture Song Build GmbH and Faktor 3 Live GmbH. Both organisers will therefore receive the contact details of the participants. Participant data will only be passed on to the partner network or third parties with a separate and event-related declaration of consent from the participants.

5. Rights of withdrawal for consumers (pursuant to § 13 German Civil Code – BGB)
Customers whose registration can predominantly neither be attributed to their commercial nor their independent professional activity are consumers within the meaning of § 13 BGB. For these participants, participation in the NEXT Conference is a leisure activity. According to § 312g Abs. 2 Nr. 9 BGB the participant therefore has no statutory right of withdrawal with regard to the purchase of a NEXT Conference Ticket.

6. Refunds / No-shows:
Refunds of attendance fees will not be entertained in the case of no-shows.
However the customer is free to transfer his or her ticket to another person named by him or her at any time before the NEXT Conference starts (please refer in this case to: [email protected]).

7. Changes to the programme
NEXT Conference reserves the right to make necessary changes to the event programme while maintaining the overall character of the event, in particular to replace announced speakers or topics.

8. Bonus to a NEXT Conference Ticket
When purchasing tickets for the NEXT Conference, the customer receives the opportunity to visit the Reeperbahn Festival to the extent desired as a bonus. With the purchase of a NEXT Conference ticket, the customer receives a free ticket for the visit to the Reeperbahn Festival on Thursday 19 September 2024. The customer can also purchase tickets for other days of the Reeperbahn Festival with the NEXT Conference ticket on request, but these must then be paid for separately. The Reeperbahn Festival is organized by Inferno Events GmbH & Co. KG, whose terms and conditions the customer recognizes by participating in the Reeperbahn Festival. Next Conference only provides the customer with paid tickets for the Reeperbahn Festival. Claims arising from these paid tickets are to be asserted exclusively against the Reeperbahn Festival.

9. Photographs and recordings
During the event, the organisers or commissioned third parties may make photo and video recordings in which the customer is recognizable. The recordings are used for the organisers’ own advertising purposes, in particular on the Internet (e.g. on their websites and social networks and video platforms as part of commercials and image films, for advertisements in affiliate links, in print media, on posters, on flyers and in electronic and postal advertising letters).

By participating in the event, the customer agrees to the creation, editing and publication of the photos and videos in which he is depicted, including by third parties, for the aforementioned purposes.

The taking of photographs, video recordings or any other recordings at the event by the customer himself requires the prior consent of the organisers, at least in text form.

The organisers shall store and archive photo and video recordings in digital and/or analog form for their own documentation purposes as well as for ‘proof and prosecution of any image rights violations committed by third parties.

10. Postponement or cancellation
NEXT Conference reserves the right to cancel or postpone the event.

In the event of cancellation of NEXT Conference events, customers who have already purchased tickets will be notified by email and the ticket price will be refunded. In this case, there is no entitlement to admission to the Reeperbahn Festival (free ticket).

In the event of a postponement of NEXT Conference events, NEXT Conference will contact customers who have purchased tickets via the email provided when purchasing the tickets. In this case, the customer may choose to attend the events on the new date or request a refund of the participation fee.

The customer must inform NEXT Conference of their decision within 14 days of receiving information about the postponement. If the customer does not notify NEXT Conference of his decision in good time, he will be contacted again at the email address he has provided. If he/she does not then expressly state within a further 14 days that he/she wishes a refund, he/she will be issued with a ticket for the postponed event and will no longer be entitled to a refund of the ticket price.

In the event of cancellation or postponement of the Reeperbahn Festival, the customer is not entitled to a (partial) refund of the participation fee for NEXT Conference events. Claims arising from any tickets for the Reeperbahn Festival purchased via the NEXT Conference must only be asserted against the NEXT Conference.

11. Liability
Next Conference excludes any liability for slightly negligent breaches of duty insofar as these do not relate to material contractual obligations (so-called cardinal obligations), damages resulting from injury to life, body or health or guarantees or claims under the Product Liability Act are affected.

Material contractual obligations are those whose fulfillment is essential for the proper performance of the contract in the first place and on the fulfillment of which the customer may rely.

In addition, NEXT Conference’s liability towards entrepreneurs for the breach of material contractual obligations is limited to the amount of damage typically foreseeable at the time of conclusion of the contract.

The same applies in each case to breaches of duty by vicarious agents and legal representatives of the organisers.

12. Lost & Found
In the event of having lost an item visitors can contact NEXT Conference via email to [email protected] with an exact description of the item.

13. Applicable law and place of jurisdiction
Applicable Law is German.

The place of fulfilment and court of jurisdiction, to the extent that this is permitted by law, is Hamburg, Germany.

14. Concluding Provisions
Should one or more provisions of these T&Cs prove invalid or contain loopholes, this does not affect the validity of the remaining terms and conditions. The parties will replace or extend the invalid or incomplete provision with an appropriate provision which comes closest to its commercial purpose.

15. Right of Modification
Furthermore, the NEXT Conference reserves the right to amend these T&Cs to improve and/or clarify the service provisions or due to changed legal provisions.
